These terms are an agreement between you and Kacper Matelski, an individual developer based in Poland ("we", "us"), about using the Netty app for iPhone. By installing or using Netty you accept them. If you do not accept them, do not use the app.
Netty is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement (the "Standard EULA") also applies to your use of the app; where these terms say more than the Standard EULA, these terms apply in addition to it. Apple is not a party to this agreement and is not responsible for the app or its content, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
1. What Netty is
Netty is a personal finance app: accounts, balances, transactions, categories and recurring items. It keeps your data on your device (and, when iCloud sync is available and turned on, in your own iCloud). The features available at any time are those described on the App Store page and in the app.
Netty is not financial, tax, legal or investment advice. Totals, conversions and insights are computed from the data and exchange rates in the app. Check important figures yourself before relying on them.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Netty on Apple devices that you own or control, as permitted by the App Store usage rules. You may not copy, modify, distribute, sell, rent, reverse-engineer or decompile the app, or remove any notices from it, except where applicable law expressly allows it.
Netty and everything in it (code, design, the Netty mascot, text and graphics) remain our property.
3. Price, subscriptions and the lifetime purchase
Netty is a paid app. After onboarding, you need one of these to use it:
- Monthly subscription, renewing every month;
- Yearly subscription, renewing every year, which includes a 7-day free trial when offered;
- Lifetime purchase, a one-time payment that unlocks Netty for as long as it is offered on the App Store. "Lifetime" means the lifetime of the app, not of the buyer: it is tied to your Apple ID, cannot be transferred, and does not entitle you to future updates, to a particular period of availability, or to a refund if Netty is withdrawn from sale (see section 6).
Prices are shown in the app before you buy, in your local currency, and are charged to your Apple ID account by Apple when you confirm the purchase.
Trials. Where a free trial is offered, your subscription starts and your Apple ID is charged when the trial ends, unless you cancel at least 24 hours before. Any unused part of a trial is forfeited when you buy a subscription.
Automatic renewal. Subscriptions renew automatically at the price shown unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the current period ends.
Managing and cancelling. You manage and cancel subscriptions in iOS Settings › Apple Account › Subscriptions, or in the App Store app. Deleting Netty does not cancel a subscription. Cancelling stops future renewals; the current period runs to its end.
Refunds. Purchases are made from Apple and refunds are handled by Apple under its rules. You can request a refund at reportaproblem.apple.com. We cannot issue refunds ourselves.
Price changes. If a subscription price changes, Apple will notify you in advance as its rules require, and you may cancel before the change takes effect.
Restoring. If you reinstall Netty or get a new device, use Restore purchases in the app to unlock it again with the same Apple ID.
When a subscription ends. If a subscription lapses, Netty locks until you resubscribe or restore. Your data is not deleted and Export my data remains available from the plans screen, so you can always take your data with you.
4. Your data
Everything you enter in Netty stays on your device and in your own iCloud. We cannot see it, and we are not responsible for it. You are responsible for keeping backups: iCloud Backup, iCloud sync when available, or the CSV/JSON export in Settings. Deleting the app deletes the data stored on that device.
How Netty treats data is described in the Privacy Policy, which is part of these terms.
5. Acceptable use
Do not use Netty for anything unlawful, do not try to break its protection or interfere with the purchase or analytics services it uses, and do not use it in a way that infringes anyone's rights. Netty is intended for people aged 16 and over.
6. Updates and changes to the app
We may update Netty to fix problems, add or change features, or keep up with iOS. Some updates may be required to keep using the app. We may also stop offering Netty or any of its plans; if we withdraw the app from sale, active subscriptions will not renew and the lifetime purchase remains usable on versions already installed, to the extent the operating system still supports them.
7. Maintenance and support
We provide support by e-mail at k.matelski1@gmail.com. Apple has no obligation to provide maintenance or support for Netty.
8. Warranties and liability
Netty is provided "as is". To the extent allowed by law, we make no warranties about its availability, accuracy or fitness for your purpose, and we are not liable for indirect losses, lost data, or decisions you make based on figures shown in the app. Our total liability to you for any claim is limited to the amount you paid for Netty in the twelve months before the claim.
Nothing in these terms limits rights that consumer protection law gives you and that cannot be excluded. If the app fails to conform to a warranty, you may notify Apple and Apple will refund the purchase price to you; beyond that, Apple has no warranty obligation whatsoever for the app.
9. Third-party claims and intellectual property
We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer protection or similar claims. We are also responsible for investigating, defending, settling and discharging any claim that the app infringes a third party's intellectual property rights.
10. Legal compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when using the app (for example Apple's and your mobile carrier's).
11. Termination
You can stop using Netty at any time by deleting it; cancel any subscription separately as described above. We may end your licence if you materially breach these terms. Sections 4, 8, 9 and 12 survive termination.
12. Governing law and disputes
These terms are governed by the law of Poland. If you are a consumer in the European Union, you also keep the protection of mandatory rules of the country you live in, and you may bring claims in the courts there. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
13. Changes to these terms
We may update these terms. The date at the top shows the current version. Material changes will be announced in the app or on the App Store page before they take effect; continuing to use Netty after that means you accept the new terms.
